Ratings911 Terms of Service

Effective Date: November 1, 2024

By using the services provided by Ratings 911 LLC ("Ratings911"), located at 1175 Shaw Ave, Suite 104, Clovis, CA 93612, you agree to the following Terms of Service. These terms govern your relationship with Ratings911 and outline the conditions under which Ratings911 provides its Google review removal services.

1. Services

Ratings911 agrees to provide services to remove online reviews identified by the client ("Client") at the time of their order. Only the reviews specified by the Client in their order will be targeted for removal. Ratings911 charges a set price per successfully removed review, and payment is required in advance.

2. Term and Termination

Term: This agreement begins upon receipt of full payment and remains effective for 90 days or until services are completed, whichever occurs first.

Termination: If the agreement is canceled or expires, Ratings911 will not issue refunds for reviews already removed. However, if no reviews are successfully removed during the term, the Client will receive a 100% refund.

3. Performance Guarantee

  • Money-Back Guarantee: If Ratings911 is unable to remove the targeted reviews within the term, the Client will receive a full refund.
  • Reinstated Reviews: If a review is reinstated within 30 days of removal, Ratings911 will attempt to remove it again at no additional charge.
  • Scope of Service: Any new or altered reviews not specified in the original order are not covered under this agreement and may incur additional fees.

4. Compensation

  • Fees: Payment is required in advance for the full cost of the review removal services, based on the number of reviews specified in the Client's order.
  • Refund Policy: If no reviews are successfully removed, the Client will receive a 100% refund of the payment made.
  • Valid Payment Method: The Client must provide a valid payment method at the time of the order.

5. Non-Payment and Breach

  • Material Breach: Failure to provide full payment in advance constitutes a material breach, and services will not commence.
  • Guarantee Conditions: Ratings911’s money-back guarantee applies only to reviews specified at the time of the order and excludes new or altered reviews.

6. Representations and Warranties

The Client represents, warrants, and covenants to Ratings911 that:

  • Criteria for Removal: All reviews provided meet at least one of the following criteria:
    • Contains trade secrets, privileged, or confidential commercial/financial information.
    • Defamatory, harassing, abusive, obscene, vulgar, or sexually explicit content.
    • Includes personal information or likeness without consent.
    • Discriminatory based on race, gender, sexuality, ethnicity, or other intrinsic characteristics.
    • False, misleading, or reasonably believed to be fake.
    • Wholly unrelated to the Client's products or services.
  • Authority: The Client affirms that they have the legal authority to request the removal of the specified reviews and that doing so complies with all applicable federal and state laws.

7. Mutual Indemnification

Each party agrees to defend, indemnify, and hold the other harmless from claims, losses, liabilities, or expenses arising from:

  • Breach of any representation, warranty, or obligation under this agreement.
  • Negligence or misconduct in performing obligations.

8. Dispute Resolution and Venue

All disputes will be resolved through mediation or arbitration in the state courts of Delaware, which will have exclusive jurisdiction. Both parties waive objections to jurisdiction or venue.

9. Confidentiality

Neither party may disclose the other's identity without written consent, except as required by law. The Client may disclose Ratings911's name when recommending its services.

10. Additional Terms

  • Exclusive Removal Rights: Ratings911 has the exclusive right to remove the reviews specified in the Client's order during the term. The Client may not independently attempt removal or engage third parties for this purpose.
  • Non-Disparagement: The Client agrees not to post negative reviews or comments about Ratings911 based on unsuccessful removal attempts.
  • Consent to Communication: The Client consents to receive SMS, calls (including automated), and emails from Ratings911 regarding service updates and promotional content. Standard messaging rates may apply. The Client may opt out of promotional messages by notifying Ratings911 in writing, but service-related communications will still be sent as necessary.
  • Assignment: This agreement is non-transferable without written consent from Ratings911.

11. Acknowledgment

By placing an order and checking the agreement box, the Client acknowledges and agrees that:

  • Ratings911 is hired solely for the removal of reviews specified in the Client's order.
  • Any independent removal efforts by the Client or third parties during the agreement term constitute a breach of this agreement.
  • If removal of a specified review occurs during the term, Ratings911 will receive full credit for the removal, and no additional refund will be issued for that review.
  • If Ratings911 is unsuccessful in removing the specified reviews, a full refund will be provided.
